HPD Section 8 Lease Renewals and Rent Increases: What Owners Need to Submit

HPD places the responsibility for requesting a lease renewal and rent increase on the property owner. A signed lease, complete request form, and supporting records should move together.

This article covers a frequently changing area of policy. Always confirm current requirements with the administering agency before acting.

HPD does not automatically convert a signed renewal lease into a new Section 8 contract rent. The owner is responsible for making the request, submitting the signed lease, supplying the supporting documents, and following the case through rent review.

Submit at least 60 days before the effective date

HPD instructs property owners to request a rent increase at least 60 days before the proposed effective date. The owner submits HPD's Rent Increase Request Form together with the signed renewal lease and any documentation needed to justify the request.

For rent-stabilized units, the separate legal timeline for offering the renewal lease may begin 90 to 150 days before expiration. Build the calendar around the earliest applicable requirement, not the latest possible submission date.

Use one complete package

The renewal submission should tell one consistent story:

  • Who owns the property
  • Who is authorized to receive payments
  • Which tenant and unit are involved
  • What the current contract rent is
  • What the proposed rent is
  • When the new term begins
  • Who pays each utility
  • Why the requested increase is lawful

Include the signed renewal lease and the supporting records relevant to the apartment, such as rent-regulation documentation or other approvals.

A missing page can turn a 60-day lead into a 60-day delay.

Submission options

HPD currently allows completed forms and documents to be submitted through the Division of Tenant and Owner Resources Owner Portal. It also publishes email, fax, and certified-mail submission options.

Current published channels include:

  • DTR Owner Portal
  • Email to S8landlords@hpd.nyc.gov
  • Fax to Owner Services
  • Certified mail to HPD Owner Services

Because contact procedures can change, confirm the current HPD owner page before sending sensitive or time-critical documents.

Whatever method is used, retain proof of submission and a complete copy of the package.

HPD will perform rent review

HPD approves or denies the request based on rent reasonableness and applicable program requirements. The proposed rent should not be confused with the maximum payment standard.

A persuasive, accurate request may include:

  • The unit's lawful regulated or unregulated rent basis
  • The signed lease
  • Correct utility responsibility
  • Reliable comparable-rent information, when appropriate
  • Explanations for unusual unit features or services
  • Regulatory approvals, when applicable

Do not inflate amenities or submit unrelated comparables. The goal is to make the request easy to verify, not to turn it into a real-estate awards submission.

Track the case after submission

A renewal is not finished when the email is sent. Track:

  • Submission date
  • Effective date requested
  • Portal status
  • Additional-document requests
  • Rent-review outcome
  • Approved tenant share
  • Approved subsidy share
  • Effective date of the new amount
  • First payment reflecting the change

When the approval arrives, compare it against the lease and ledger. An approved contract rent can still be posted incorrectly if the effective date or tenant share is entered wrong.

Common HPD renewal problems

  • The signed lease was omitted
  • The rent request form and lease show different amounts or dates
  • The package was submitted fewer than 60 days in advance
  • The unit's legal rent records do not support the request
  • Utility responsibility was entered incorrectly
  • Ownership or payee information is outdated
  • The case failed rent reasonableness
  • The owner did not see or answer an additional-document request

Before submitting, create a one-page cover sheet listing the tenant, property, unit, current rent, requested rent, lease term, utility setup, documents enclosed, and requested effective date. This is not a substitute for HPD's forms. It is a quality-control tool for the owner and a roadmap for whoever reviews the file.

The agencies have enough forms. Your internal process should make the forms easier to manage, not create another mystery.
